Terms of Service

Introduction

These Terms of Service ("Terms") govern your use of FoodSavr — the grocery and food-tracking apps and web experience (for example app.foodsavr.ca). By accessing or using FoodSavr, you agree to these Terms and the FoodSavr Privacy Policy (for example at foodsavr.ca/privacy).

1. Agreement to Our Legal Terms

FoodSavr("FoodSavr," "we," "us," "our") means the FoodSavr applications and related services that link to these Terms (collectively, the "Services"). Contact the FoodSavr team using the email below.

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and FoodSavr, concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms.

2. Our Services

The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Services from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

Service availability and operational limits

We strive to keep the Services available, but we do not guarantee uninterrupted access, error-free operation, or any minimum uptime. The Services may be modified, suspended, or discontinued in whole or in part.

Inventory, expiry dates, and reminders are informational only. They depend on what you enter, device time settings, OS notification permissions, and network connectivity. We do not warrant that reminders, analytics, or notifications will always be delivered or accurate.

Like any software, FoodSavr may experience bugs, data loss, or sync issues. You are responsible for maintaining copies of important information where appropriate. The Privacy Policy describes usage analytics (Firebase Analytics, PostHog) and crash and diagnostic reporting on supported platforms (Firebase Crashlytics on native mobile per Google's documentation). We use these tools to improve stability and the product; they do not guarantee that every failure will be detected or fixed before it affects you.

Device permissions, notifications, widgets, and email

Your device operating system controls permissions (camera, microphone, speech recognition, photos/files, notifications, and similar). You can grant or deny them; some features may not work without the relevant permission. On Android, FoodSavr may use vibration for notifications and may reschedule notifications after a device restart so reminders remain scheduled.

If you use an optional home screen widget, information you choose to display there (for example item names, counts, or kitchen name) may be visible to anyone who can see your device. You are responsible for deciding whether to use the widget and for device security.

If you opt in to email notifications, we send messages to your account email (or address you provide) using providers described in the Privacy Policy; content may include item-related information such as names or counts.

FoodSavr does not use precise GPS location in the current product build for these features; if that changes, we will update the Privacy Policy and product disclosures.

Free app, monthly AI quotas, and item-photo storage

FoodSavr is free to download on supported app stores (for example Google Play for Android) and free to use on the web (for example app.foodsavr.ca) and on mobile for grocery tracking, inventory, reminders, and related core features. There is no charge to create an account or use standard functionality in the current product.

AI features that process images or text in the cloud (including scans, Sous Chef chat, and other cloud-AI flows) are subject to per-account monthly quotas. AI scan and Sous Chef chat usage resets on the first day of each calendar month in UTC, consistent with the in-app Usage & limits for this month section and server-side rollover.

Item photos attached to inventory items count against a separate storage quota that does not reset each month; you manage that quota by removing photos or items as described in the app.

You may email foodsavrapp@gmail.com to request higher limits or exceptions; we may grant such requests selectively at our sole discretion. FoodSavr does not currently sell subscriptions or take payment inside the app. If we introduce optional paid options in the future, we will update these Terms and the Privacy Policy.

3. Intellectual Property Rights

Our intellectual property

We are the owner or the licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics in the Services (collectively, the "Content"), as well as the trademarks, service marks, and logos contained therein (the "Marks").

Our Content and Marks are protected by copyright and trademark laws (and various other intellectual property rights and unfair competition laws) and treaties around the world.

The Content and Marks are provided in or through the Services "AS IS" for your personal, non-commercial use or internal business purpose only.

Your use of our Services

Subject to your compliance with these Legal Terms, we grant you a non-exclusive, non-transferable, revocable license to:

• Access the Services; and
• Download or print a copy of any portion of the Content to which you have properly gained access

solely for your personal, non-commercial use or internal business purpose.

4. User Representations

By using the Services, you represent and warrant that:

• You have the legal capacity and you agree to comply with these Legal Terms
• You are not a minor in the jurisdiction in which you reside
• You will not access the Services through automated or non-human means, whether through a bot, script or otherwise
• You will not use the Services for any illegal or unauthorized purpose
• Your use of the Services will not violate any applicable law or regulation

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Services (or any portion thereof).

Your account and your content

You are responsible for safeguarding your account credentials and for activity under your account. You are responsible for the accuracy and legality of content you submit (including inventory data, photos, grocery lists, and messages you send to AI-assisted features). You represent that you have the rights needed to upload that content. We may remove content or restrict accounts that violate these Terms or applicable law.

5. Prohibited Activities

You may not access or use the Services for any purpose other than that for which we make the Services available. The Services may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.

As a user of the Services, you agree not to:

• Systematically retrieve data or other content from the Services to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us
• Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords
• Circumvent, disable, or otherwise interfere with security-related features of the Services
• Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Services
• Use any information obtained from the Services in order to harass, abuse, or harm another person
• Make improper use of our support services or submit false reports of abuse or misconduct
• Use the Services in a manner inconsistent with any applicable laws or regulations
• Engage in unauthorized framing of or linking to the Services
• Upload or transmit viruses, Trojan horses, or other material that interferes with any party's uninterrupted use and enjoyment of the Services
• Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools

6. AI-Powered Features and Disclaimers

Third-party AI providers (FoodSavr is an intermediary)

FoodSavr does not own or operate the underlying AI models. We send your inputs to third-party APIs (including Google Gemini and Anthropic Claude where enabled) so those providers can return results. Accuracy, availability, and security of AI processing depend on those providers and your connection. We do not use your content to train FoodSavr-owned models, and we do not collect your photos or messages to sell them or provide them to data brokers. How API providers treat prompts and outputs (including training, retention, and abuse prevention) is governed by their terms — see the Privacy Policy for links and details.

Sous Chef (AI chat) feature

Our Sous Chef feature uses artificial intelligence to generate recipe suggestions, cooking instructions, and food-related advice. You acknowledge and agree that:

• No Guarantee of Accuracy: AI-generated recipes and cooking advice may contain errors, omissions, or inaccuracies that could affect food safety, nutritional content, or cooking results.
• Food Safety Responsibility: You are solely responsible for verifying the safety of all ingredients, cooking methods, and food handling practices suggested by the AI.
• Dietary and Allergy Considerations: The AI may not accurately identify allergens or dietary restrictions. Always verify ingredient lists and consult healthcare professionals for dietary advice.
• Not Professional Advice: AI-generated content does not constitute professional culinary, nutritional, or medical advice.
• Independent Verification Required: You must independently verify all recipes, ingredients, cooking times, temperatures, and safety instructions before use.

AI Item Scanning and Recognition

Our AI-powered item scanning feature attempts to identify food items through image analysis. You acknowledge and agree that:

• Recognition Limitations: AI may misidentify items, miss important details, or provide incorrect information about products, expiration dates, or nutritional content.
• Manual Verification Required: Always manually verify scanned item information, especially for critical details like expiration dates, allergen warnings, and product specifications.
• No Food Safety Guarantee: Do not rely solely on AI scanning for food safety decisions. Check items personally for signs of spoilage, contamination, or expiration.
• Third-Party Product Information: AI may reference third-party databases that may be outdated, incomplete, or incorrect.

General AI Limitations and User Responsibilities

• Experimental Technology: AI features are based on experimental technology that may occasionally generate inappropriate, biased, or harmful content.
• Underlying model limitations: AI responses depend on providers' base models and training data, which may be outdated, incomplete, or contain biases.
• No Human Oversight Guarantee: While we strive to improve AI accuracy, we cannot guarantee human review of all AI-generated content.
• User Discretion Required: You must exercise your own judgment and common sense when using AI-generated information.
• Professional Consultation: For serious health, safety, or dietary concerns, consult qualified professionals rather than relying on AI suggestions.

7. Services Management

We reserve the right, but not the obligation, to: (1) monitor the Services for violations of these Legal Terms; (2) take appropriate legal action against anyone who, in our sole discretion, violates the law or these Legal Terms; (3) in our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable any of your Contributions or any portion thereof; (4) remove from the Services or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems; and (5) otherwise manage the Services in a manner designed to protect our rights and property and to facilitate the proper functioning of the Services.

8. Term and Termination

These Legal Terms shall remain in full force and effect while you use the Services. We reserve the right to, in our sole discretion and without notice or liability, deny access to and use of the Services (including blocking certain IP addresses), to any person for any reason or for no reason.

If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party.

Account deletion and data removal

If you request deletion of your account and personal data — including through the Delete accountcontrol in the app's profile / account settings — we may immediately log your name, email, and the time of the request in our profiles_deleted table and send a confirmation email to you and our team inbox. That control does not delete your account by itself. We review each request before deletion. If approved, we aim to complete deletion of your account within fifteen (15) days after review, subject to technical and legal constraints. We will send you confirmation when deletion is complete. As described in the Privacy Policy, we may retain only a minimal record (for example name and email and related timestamps or internal notes) to document that the account was deleted — not your inventory, photos, or chat content.

9. Limitations of Liability

This limitation of liability extends specifically to any damages that may result from:

• Use of AI-generated recipes, cooking instructions, or food recommendations
• Reliance on AI item scanning or food identification features
• Food-related illness, injury, or adverse reactions
• Inaccurate expiration date detection or food safety assessments
• Errors in nutritional information or dietary recommendations
• Missed or incorrect reminders, notifications, or inventory tracking
• Loss or corruption of data, failed sync, or third-party service outages
• Any AI-generated content that proves to be incorrect, incomplete, or harmful

You acknowledge that food safety and dietary decisions are your sole responsibility, and you use our AI features at your own risk.

10. Disclaimer

We make no warranties or representations about the accuracy or completeness of the Services' content or the content of any websites or mobile applications linked to the Services and we will assume no liability or responsibility for any errors, mistakes, or inaccuracies of content and materials.

Specifically regarding AI features: We make no warranty that AI-generated content will be accurate, safe, appropriate, or suitable for your intended use. AI-powered features are provided for convenience only and should not be relied upon for critical food safety, health, or dietary decisions.

Analytics and crash reporting: We use third-party tools to measure usage and diagnose crashes. Those services may not always function; outages or configuration changes on their side are outside our control.

11. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page will change when we do. If changes are material, we may provide additional notice (for example in-app or by email where appropriate). Your continued use of the Services after the effective date of updated Terms means you accept the revised Terms.
